Understanding Turkish Real Estate Taxes & Closing Costs

1. Title Deed Transfer Fee (Harçlar Kanunu No. 492, Tariff No. 4):
The statutory title deed fee is levied at 2% on the buyer and 2% on the seller (4% total) based on the declared sales price, which cannot fall below the registered municipal tax value. In international transactions, foreign buyers are routinely asked by sellers to absorb the full 4%. Under-declaring the price triggers substantial tax loss penalties under Article 63 of Law No. 492.
2. VAT Exemption for Foreign Buyers (KDV Kanunu No. 3065, Article 13/i):
Foreign non-residents acquiring first-delivery residential or commercial units directly from construction companies are exempt from Value Added Tax (VAT 0%), provided the purchase funds are brought into Türkiye in foreign currency through a banking institution (DAB certificate). If the property is sold within 3 years, the exempt VAT must be repaid with statutory interest.
3. Mandatory SPK Valuation Report (TKGM Circular 2019/1):
Every real estate transaction involving a foreign buyer requires an official valuation report prepared by an appraiser licensed by the Capital Markets Board (SPK). The declared transaction value on the title deed cannot be lower than the SPK report figure.
